Agreement to These Terms

These Terms of Service (“Terms”) govern your use of the Virginia Local website and your participation in our business spotlight program. By using our website or submitting an application, you agree to these Terms. If you do not agree, please do not use our website or apply.

Our Service

Virginia Local features and promotes local businesses on our community websites, such as Williamsburg Local and New Kent Local. When we feature a business, we may also promote it through our email list, social media channels, and paid advertising, at no cost to the business.

Applications and Eligibility

You must be at least 18 years old to apply and to be featured.

Submitting an application does not guarantee that you will receive an interview or be featured. We reserve the right to decide, at our sole discretion, whether a business receives a spotlight interview and whether any spotlight interview is published.

No Guarantee of Publication

Listings and spotlights are not guaranteed to be published. We may decline to publish, and we may remove any listing or spotlight at any time, at our sole discretion.

Spotlight Content and Ownership

If you move forward with getting featured, the content produced from your interview — including recordings, written spotlights, images, and related materials — is owned by Virginia Local. We may publish, edit, promote, or remove that content at our discretion across our community websites, email list, social media, and advertising.

You are responsible for ensuring that any materials you provide to us (such as logos, photos, or information about your business) are accurate and that you have the right to share them with us.

Accuracy of Business Information

Virginia Local is not responsible for maintaining the accuracy of the information posted about featured businesses on our website. Each featured business is solely responsible for the accuracy of its own information. If anything needs to be changed or updated, the business should contact us through our contact form.

No Guarantee of Results

We do not guarantee any particular results from being featured, including but not limited to website traffic, leads, phone calls, clients, sales, or revenue. Any examples or expectations we share are not promises of results.

Giveaways and Raffles

From time to time, Virginia Local runs giveaways and raffles featuring prizes sponsored by local businesses. By entering or participating, you agree to the following:

How to enter. You enter by taking part in the community and social media activities we describe for each giveaway — for example, subscribing to our email list or following our Facebook page. The specific entry steps are announced with each giveaway.
No purchase necessary. No purchase or payment of any kind is ever required to enter or win.
Age requirement. You must be at least 18 years old to enter or win.
Limit on winning. A person may win a maximum of two (2) prizes per calendar year.
In-person delivery. Prizes are delivered in person. You may be required to show valid photo identification to confirm your age and identity before receiving a prize.
No cash value. Prizes have no cash value and cannot be exchanged, transferred, or redeemed for cash. If an advertised prize becomes unavailable, we may substitute a prize of equal or greater value.
Sponsoring businesses are not obligated to winners. The businesses that sponsor prizes, deals, or discounts are not obligated to winners and may stop honoring an announced deal or discount at any time.
Photos and video. We may photograph or record winners and participants and post that content on our website and social media channels. By participating, you consent to this use without additional compensation.
Winner selection. Unless a specific giveaway states otherwise, winners are selected at random. Odds of winning depend on the number of entries received.
Claiming a prize. If we are unable to reach a selected winner, or a prize is not claimed within a reasonable time, the prize may be forfeited and awarded to another participant.
Eligibility and disqualification. We reserve the right to verify eligibility and to disqualify anyone who violates these Terms, tampers with a giveaway, or provides false or misleading information.
Taxes. Winners are solely responsible for any taxes that may apply to a prize.
Release of liability. By participating, you release Virginia Local and the sponsoring businesses from any and all liability arising from your participation or from any prize.
Changes and cancellation. We reserve the right to modify, suspend, or cancel any giveaway or raffle at any time, for any reason.
No affiliation with social platforms. Our giveaways and raffles are not sponsored, endorsed, administered by, or associated with Facebook, Instagram, YouTube, or any other social media platform.
Void where prohibited. Giveaways and raffles are void where prohibited or restricted by law.
Additional rules. A specific giveaway or raffle may include additional rules. Those rules supplement these Terms, and if there is a conflict, the specific rules control.

Intellectual Property

The Virginia Local website, including its design, text, graphics, and branding, is owned by Virginia Local and protected by applicable laws. You may not copy or reuse it without our permission.

Third-Party Links

Our website may link to third-party websites, including our community sites and external services. We are not responsible for the content, policies, or practices of those third-party sites.

Disclaimer of Warranties

Our website and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Virginia Local will not be liable for any indirect, incidental, or consequential damages arising from your use of our website or participation in our spotlight program.

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules.

Changes to These Terms

We may update these Terms from time to time. When we do, we’ll revise the effective date at the top of this page.
